Dalyellup

After almost 12 months of debate, a regional council has come to a decision regarding a basketball court that has divided a community.

Key points:

  • Capel shire decides to remove a basketball court and replace it with a new one
  • The removal and re-build is expected to cost more than $18,000
  • The new court will be built 200 metres from the current site

Capel Shire Council has narrowly voted to remove the court in Dalyellup, 180 kilometres south of Perth, due to continued noise complaints from residents.

The court on Daablone Vista will be relocated to Beach Park, about 200 metres away at the end of Norton Promenade.

The work is expected to cost more than $18,000.

Shire President Michael Southwell said despite the proximity, the council was confident the new court would not cause similar issues.

"It's far enough away from houses that we won't have to worry about similar complaints in the future," he said.

Homeowner pays for own noise report

Calls for the management of noise from the court started in November last year.

The surrounding houses are less than 25 metres away and residents became frustrated about noise levels at night.

One homeowner believed the sounds were loud enough to exceed permitted noise levels and commissioned their own auditory report.

A shire investigation said if activity was conducted at night or in the early morning, it would "unreasonably interfere with the comfort and amenity of nearby homes".

In April, the council proposed restricting ball sports at the court after 7:00pm, but following community consultation it twice voted to defer a decision.

Restricted use was never formally voted on. On Wednesday night, the council voted 4-3 to relocate the court.

Mr Southwell said he was happy a resolution had been reached.

"People will be pleased to know it's finally off our agenda and we can concentrate on other improvements for Dalyellup," he said.
